Photo Usage Rules
Version 1.0 · Effective from 01/11/2026
Search for and use only your own photos, what you may do with them, what is prohibited, and how to ask for a photo of you to be taken down — even without an account.
These Rules apply to the timanh.vn website and form an integral part of the Terms of Use.
1. Purpose
These Photo Usage Rules (the “Rules”) help everyone using timanh.vn find, download and share Event photos in a way that respects the privacy and image rights of the people in them and the copyright of the photographers. They are issued by XMAX MEDIA JOINT STOCK COMPANY (XMAX MEDIA JSC) (the “Company”, “we”, “us”).
2. General principles
- Everyone has rights over their own image under Article 32 of the Civil Code and personal data protection law. Images from sporting competitions and public activities may be recorded and used provided the honour, dignity and reputation of the person pictured are not harmed.
- Event photos are works protected by intellectual property law.
- The Service exists so you can find your own memories, not to search for or track other people.
3. Only search for and download photos of yourself
- Search for and download only photos of yourself, or of another person who has consented or authorised you — for example a friend who asks you to look for their photos using their BIB number.
- A parent or guardian may search for and download photos of a minor in their care.
- If your search results contain photos of other people, please do not download, use or share them.
4. Searching by face
- Use only a face photo of yourself; of a minor for whom you are the parent or guardian; or of another person who has clearly agreed to let you use their face photo to find their photos, under the Face Data Policy. You are responsible for being able to prove that agreement if asked.
- It is prohibited to use another person's face photo without their consent, even if you happen to have a photo of them.
- It is prohibited to use the Service to track, stalk, harass or threaten anyone; to identify strangers; to find out which events a person attended or where they were; or to collect or compile images of other people.
- You may save several different photos of yourself — for example with and without a cap — to improve your chances of being found.
5. Using photos
5.1. Permitted
- Keeping your photos as a memento; printing them for personal and family use.
- Sharing your photos on your personal social media; crediting the photographer where asked to.
- Creating and sharing your own finisher certificate for Events that support it.
5.2. Not permitted
- Using photos for commercial purposes — advertising, sales, brand promotion, sponsor activity, printing for sale — without the Company's written permission and, where needed, the consent of the people pictured.
- Reselling, renting, transferring or distributing photos to others.
- Removing, cropping or obscuring watermarks or copyright notices; screenshotting a preview to use in place of an Original Photo.
- Editing or compositing photos — including using artificial intelligence to create fakes — in a way that distorts the image or harms the honour, dignity or reputation of the people in them.
- Harvesting photos in bulk with automated tools, or using photos to build datasets or train artificial intelligence models.
- Publishing photos together with another person's personal information without their consent.
6. Photos with several people
Many photos also show other runners. When sharing, respect them: do not make disparaging comments, do not tag or share their information without consent, and consider cropping if someone would rather not appear.
7. Asking for a photo of you to be removed or hidden
Anyone appearing in an Event photo, whether or not they have an account, may ask for a photo of them to be removed or hidden, or ask that their face in it not be used for search.
- Email [email protected] with the subject “Photo takedown request”.
- Give the Event name, a link to or screenshot of the photo, and your reason (optional).
- Give what we need to verify that you are the person pictured or their legal representative — for example your BIB number, the distance you ran, or a description of what you were wearing. We do not ask for photographs of identity documents and use this information only to handle your request.
We acknowledge your request within 2 working days and may hide the photo while we review it. Requests are completed within the deadlines in Decree No. 356/2025/ND-CP (at most 20 days for deletion, extendable once, in which case we will tell you). Where a request is accepted, the photo is removed from search results and from the Service's galleries, or your face features in that photo are removed from the search index, according to what you asked for.
We prioritise requests involving children, sensitive images (wardrobe mishaps, injuries, medical emergencies) and cases where there is a risk of harassment. Removing a photo may affect other people who also appear in it; we weigh the interests of everyone concerned reasonably.
8. Reporting a breach
If you find your photos being used without permission (for example in advertising), edited offensively, or you suspect someone is using the Service to track or harass another person, tell us at [email protected] with the relevant details and evidence. We will review it, take appropriate measures within the Service, and work with the competent authorities where necessary.
9. Copyright
- Copyright in Event photos belongs to the Company and/or the photographers and partners concerned, under intellectual property law.
- Downloading a photo grants only a licence to use it under these Rules; it does not transfer copyright.
- Organisations, businesses, sponsors or news media wishing to use the photos should contact [email protected] for a licence.
10. Enforcement
Depending on the seriousness of a breach, the Company may: issue a warning; remove the offending content; delete a face that was used improperly; revoke access to photos; restrict features (for example face search); suspend or terminate the account; and notify the competent authorities. Anyone in breach remains personally liable under the law and for any damages.
