Terms of Use

These Terms apply to the timanh.vn website. The Tìm Ảnh mobile app and the bananh.vn website have their own legal documents.

1. Introduction and acceptance

These Terms of Use (the “Terms”) are an agreement between you and XMAX MEDIA JOINT STOCK COMPANY (XMAX MEDIA JSC), enterprise code 0110577248, with its registered office at No. 18 Dong Nhan Street, Hai Ba Trung Ward, Hanoi, Vietnam (the “Company”, “we”, “us”), governing your use of the timanh.vn website and the online services provided through it (together, the “Service”).

By accessing, registering, signing in or using any feature of the Service, you confirm that you have read, understood and agree to these Terms together with the documents that form an integral part of them: the Privacy Policy, the Face Data Policy, the Photo Usage Rules, the Cookie Policy (together, the “Legal Documents”). If you do not agree, please do not use the Service.

Your account is shared, by email address, with the Company's bananh.vn website and the Tìm Ảnh mobile app. When you use those platforms, the legal documents published on the platform concerned apply.

2. Definitions

• Event: a running race, sports competition or other event whose photos and videos are offered on the Service.
• Event Photo: a photo or video taken at an Event by a photographer of the Company or of its partners.
• Preview: a downsized or watermarked version of a photo, used to view and check it before downloading or buying.
• Original Photo: the high-quality photo or video file, without a watermark.
• Face Data: the face photo you upload and the face feature vector derived from it, processed under the Face Data Policy.
• Account: the account you use to sign in to the Service.

3. What the Service does

The Service lets you:

• find your photos at an Event using a face photo (a selfie) or a BIB number;
• browse an Event's photo gallery;
• download photos of free Events at no charge;
• save the face you searched with, so that you do not have to upload a photo again next time;
• create a finisher certificate for Events that support it.

Features may differ from Event to Event, and some Events require a password issued by the organiser. We may update, change or temporarily suspend part of the Service, for example for maintenance, and will post a notice on the website where we can.

Search results are produced automatically by recognition technology and are not guaranteed to be complete or exact: photos of you may be missed, and photos of other people who look similar may be returned. Please check before downloading.

4. Eligibility and age

• You must be at least 16 years old. A person under 16 may use the Service only with the consent and supervision of a parent or guardian, who accepts these Terms on their behalf and is responsible for their use.
• Creating Face Data for a person under 16 must be done or consented to by a parent or guardian.
• You have the legal capacity to enter into this agreement and are not barred from using the Service under applicable law.

5. Your account

• You can browse galleries and search at most Events without registering. Saving a face and some personal features require you to sign in.
• You register with an email address and a password, or sign in with a Google account. The information you give us must be accurate and kept up to date.
• You are responsible for keeping your password confidential and for all activity under your account. Tell us at [email protected] as soon as you suspect unauthorised use.
• Use only your own account; accounts may not be transferred, lent or sold.
• You may delete your account at any time — see Delete your account and data.

6. Searching by face and by BIB number

• To search by face you upload a photo containing a face. Your browser downsizes it before sending; our system derives a face feature vector from the largest face in the photo and matches it against the Event's photos. See the Face Data Policy for details.
• You may only use a face photo of yourself, of a minor for whom you are the parent or guardian, or of another person who has clearly agreed to let you search for their photos. Using the Service to identify, track or collect images of strangers is prohibited.
• A face you choose to save is tied to your account and also remembered in your browser so it appears next time. You can delete it at any time.
• The system limits how many searches may be run in a given period in order to prevent abuse. If you search many times in a row, please wait a few minutes and try again.

7. Downloading photos

Searching, viewing and downloading photos of Events on timanh.vn is free of charge. We charge nothing and will never ask you to pay anything on this website. For Events whose photos are sold, you are taken to the Company's bananh.vn website, and purchases there are governed by the terms published on that website.

Downloaded photos are licensed for personal, non-commercial use under the Photo Usage Rules.

8. Intellectual property

Event Photos, the interface, logos, source code, databases and all other content of the Service are protected by intellectual property law. Copyright in Event Photos belongs to the Company and/or the photographers and partners concerned.

Downloading a photo gives you only a non-exclusive, non-transferable licence for personal, non-commercial use under the Photo Usage Rules; it does not transfer copyright. Organisations, businesses, sponsors or news media wishing to use the photos should contact [email protected] for a licence.

9. Prohibited conduct

When using the Service you must not:

• use another person's face photo without their consent, or use the Service to identify, track, stalk, harass or collect images of other people;
• download photos in bulk using automated tools, crawlers or scripts, or in any way that goes beyond ordinary personal use;
• use photos from the Service to build datasets or train artificial intelligence models;
• remove, crop or obscure watermarks or copyright notices; resell, rent or redistribute photos;
• probe or scan for vulnerabilities, mount denial-of-service attacks, or gain unauthorised access to another user's account or to our systems;
• interfere with, reverse engineer, copy or create derivative works from the software behind the Service;
• impersonate another person, give false information, or use the Service for any unlawful purpose.

10. Third-party content and links

The Service may link to websites of event organisers, sponsors or other third parties. We do not control and are not responsible for the content, products or policies of those websites.

11. Suspension and termination

We may restrict features, suspend or terminate your account where we have grounds to believe you are in breach of these Terms or the Legal Documents, or where this is necessary to protect other users and our systems. Except in an emergency or where the law provides otherwise, we will tell you why and give you an opportunity to respond. You may stop using the Service at any time by deleting your account.

12. Disclaimers and limitation of liability

• The Service is provided “as is”. We make reasonable efforts to keep it running and its results accurate, but we do not warrant that the Service will be uninterrupted or error-free, or that every photo containing you will be found.
• We are not liable for loss arising from your misuse of photos, from inaccurate information you provide, from disclosure of your sign-in details, or from faults in your own connection or device.
• In all cases our liability to you is limited to the direct and actual loss you suffer, unless the law provides otherwise.
• These limits do not apply to loss caused by our wilful misconduct and do not restrict your rights as a consumer under the Law on Protection of Consumer Rights No. 19/2023/QH15.

13. Changes to these Terms

Each version of these Terms carries a version number and an effective date, shown at the top of this page. Where a change is significant we will post a notice on the website before the new version takes effect and, where the law requires it, ask for your consent again. Continuing to use the Service after the effective date means you accept the new version.

14. Governing law and disputes

These Terms are governed by the laws of Vietnam. Please send any complaint to [email protected]; we acknowledge it within 2 working days and seek to resolve it in good faith. A dispute that cannot be settled by negotiation will be brought before a competent court in Vietnam, consistently with the Law on Protection of Consumer Rights No. 19/2023/QH15 and the Law on E-Commerce No. 122/2025/QH15.
